Who these terms are for
FleetStream (“FleetStream”, “we”, “us”) provides fleet management software through its website and web app at fleetstream.io (the “Web App”) and the FleetStream Shift app for iOS and Android (“FleetStream Shift”), together “the service”. The service is for fleets and the people their administrators invite, such as drivers and fleet staff. You must be at least 18 years old.
By using the service you agree to these terms. If your fleet has signed a separate agreement with FleetStream, that agreement controls where it differs from these terms. How we handle personal information is in our Privacy Policy.
Your account
- You get access when a fleet invites you. Use the e-mail address the invitation was sent to.
- Give accurate information and keep it current.
- Keep your sign-in secure. Do not share it. You are responsible for what is done with your account.
- Tell us right away at support@fleetstream.io if you think someone else has used your account.
- Your fleet’s administrators control your access and can suspend or remove it.
Acceptable use
You agree not to:
- break the law, or use the service to harm, harass or defraud anyone;
- send a false or test SOS alert, or misuse any other safety feature;
- enter information you are not allowed to enter, or that you know is wrong, in a fleet’s records;
- access records of a fleet you do not belong to, or try to get around the limits on what your role can see;
- probe, scan or test the service’s security, or interfere with it, without our written permission;
- copy, scrape, resell or reverse engineer the service, except as the law allows;
- upload malware or anything else meant to damage the service or other people’s devices;
- use the repair payment card for anything other than the repair it was issued for.
Your content and your fleet’s data
The records, photos, documents and other material a fleet and its people put into the service stay theirs. You give FleetStream the right to store, process and display that material, and to share it with the providers listed in our Privacy Policy, only as needed to run and protect the service. Your fleet is responsible for having the right to enter the information it enters and for giving its people any notices the law requires.
The SOS feature does not call emergency services
FleetStream Shift’s SOS feature sends an alert, and your position if your phone allows it, to your fleet only. Your fleet sees the alert in FleetStream. Nobody is called, texted or e-mailed automatically because of it. It does not contact 911 or any other emergency service, the police, an ambulance or a tow service, and FleetStream does not either.
In an emergency, call 911 (or your local emergency number) yourself. Do not wait for your fleet to answer an alert.
An alert depends on your phone, its network connection, its permissions and your fleet’s people seeing it. We cannot promise that an alert will arrive or be answered, or how fast.
AI-assisted features
Some features use AI: to read documents, such as a photo of a shop’s repair estimate, and to suggest codes, and in the Web App’s AI assistant, to answer questions about your fleet’s records. A reading or an answer can be wrong, incomplete or out of date. Check it against the document or the records before you rely on it, do not make a decision about a person, a safety matter or compliance on an answer alone, and treat anything the service marks for review as needing a person’s decision.
Driver safety scores are worked out automatically from the data a connected telematics service sends. A score can be wrong and is a tool for the fleet, not a finding about a person.
Repair payment cards and other providers
Repair payment cards are issued by a third-party card provider, and your fleet’s administrators decide who may use one and for what. The provider’s own terms apply to the card. The service also relies on other providers, such as Google Maps; they are named in the Privacy Policy, and we are not responsible for their services.
Our rights in the service
FleetStream and its licensors own the service, including its software, design and trademarks. We give you a limited, personal, non-transferable right to use it for your fleet’s business while you have access. We do not give you any other right in it.
Ending your use
You can stop using the service at any time, and you can ask to have your account deleted (see Delete Account). We may suspend or end your access if you break these terms, if your fleet asks us to, or if we must for legal or security reasons. Sections that by their nature should survive, such as ownership, the disclaimers, the limit of liability and governing law, do.
No warranty
The service is provided “as is” and “as available”. To the fullest extent the law allows, FleetStream makes no promises that the service will be uninterrupted, error free or secure against every threat, or that it fits a particular purpose, and disclaims all implied warranties. FleetStream does not give legal, safety or compliance advice. Your fleet remains responsible for its own compliance obligations.
Limit of liability
To the fullest extent the law allows, FleetStream is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, and its total liability for all claims about the service is limited to the amount your fleet paid FleetStream for the service in the 12 months before the event that gave rise to the claim.
Some places do not allow certain limits. Nothing in these terms limits a liability that cannot be limited by law, including for death or personal injury caused by negligence where that applies.
Governing law
[PLACEHOLDER, TO BE COMPLETED BY COUNSEL: governing law, venue and how disputes are resolved. Until this is filled in, these terms do not pick a governing law.]
Changes to these terms
We may update these terms. When we do, we change the date at the top of this page and, for a material change, give notice in the service or by e-mail. Using the service after a change means you accept it.
